Terms and Conditions

1. To participate in a Start With A Date event, you must register and agree to be bound by these Terms and Conditions (Agreement) and confirm that you have read these Terms and Conditions. This Agreement sets out the legally binding terms for your participation in a Start With A Date event. Start With A Date, LLP may modify this Agreement from time to time.

By registering for a Start With A Date event, you are agreeing that Start With A Date is not liable for any damages, direct or indirect, incidental and/or consequential, arising out of attendance at Start With A Date events, including, without limitation, to damages arising out of communicating and/or meeting with other participants at these events. Such damages include, without limitation, physical damages, bodily injury and/or emotional distress. You also understand and acknowledge that Start With A Date events are held at venues of which Start With A Date has no control. In the event that you are injured or suffer damages in any regard at a Start With A Date event, you agree to release Start With A Date from any liability with respect thereto.

2. You must be at least twenty-one years old and single or legally separated to participate in a Start With A Date event. By participating in a Start With A Date event, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the terms and conditions of this Agreement.

3. We will make every effort to hold events at the dates, times and locations specified on our web site. We do reserve the right to cancel and/or change event dates, times and locations although this happens very rarely. In the very unlikely event that circumstances dictate that we do postpone an event, you will be refunded your money in full.

You may cancel your participation at any time, for any reason by sending a written notice of cancellation to Start With A Date via email at info@startwithadate.com . Or, you may call Start With A Date at 701-391-3539. Any cancellation notice received 72 or more hours prior to the scheduled time of the event will be entitled to a refund of your money, minus a $5 processing fee. Any cancellation notice received less than 72 hours before the scheduled time of the event will not be entitled to a refund. Start With A Date, in its sole discretion, reserves the right to discontinue any discount applied to a registration that is cancelled prior to the event. We also reserve the right to terminate or restrict your participation at a Start With A Date event, without prior notification. If your rights are so terminated you will not be entitled to a refund.

4. Start With A Date is not a matchmaking service. Our goal is to help single people meet one another in a safe and comfortable setting. Start With A Date does not screen participants or verify personal information, such as marital status or any other aspects of their general background. It is up to you to clarify these issues to your own satisfaction. Attendance at any Start With A Date event is done so at your own risk. You agree to waive all liability against Start With A Date, LLP, and the venue that this event is held at, any sponsors and/or partners associated with Start With A Date and all staff members and volunteers associated with Start With A Date.

5. You hereby acknowledge and understand that by participating in any Start With A Date event your first name and ID #, phone number and/or email address that you authorized will be provided to certain other participants.

6. Start With A Date, LLP, its affiliates and/or various third parties do not guarantee that any participant will successfully match with any other participant or that participation will be successful or that participation will result in actual dates or introductions. You agree to release Start With A Date, LLP, its affiliates and/or various third parties and assume the full responsibility and risk with respect to the outcome of any relationship that may or may not arise between you and other event participants.

7. Start With A Date, LLP, along with certain permitted third parties, may photograph and/or make audio/video recordings of any of the Start With A Date events. At no time will there be an audio recording of any actual ‘dates'. By attending and participating in any Start With A Date event, each participant agrees to permit the taking of any such photographs and to be recorded in both audio and video media. Thus, each participant at a Start With A Date event irrevocably authorizes Start With A Date, its agents, representatives, successors and assigns to use in perpetuity, throughout the world, in any manner whatsoever, all or any portion of photographs and audio/video recordings in which such participant appears, and any comments, statements or testimonials made by such participant, while attending a Start With A Date event. Such photographs may be used by Start With A Date, LLP, its agents, representatives, successors and/or assigns for any legal purpose including, without limitation, marketing and advertising. No person shall be entitled to any compensation in connection with the use and exploitation of any photographs, audio and/or video recordings.

8. You agree to indemnify and hold Start With A Date, LLP, its employees, volunteers, business partners, affiliates and/or various third parties, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your participation in any Start With A Date event.

9. All title, ownership and intellectual property rights, including the rights to copyright, trademarks, service marks and logos (collectively, the “Intellectual Property”) are vested in Start With A Date, LLP. Nothing contained herein should be construed as granting, by implication, estoppel or otherwise, any license or right to use any of the Intellectual Property without the written permission of Start With A Date, LLP.

10. This Agreement is governed by the laws of the State of North Dakota; without regard to it's conflict of laws provisions. You consent and submit to the exclusive jurisdiction of the State and Federal Courts located in Burleigh County, North Dakota in all matters involving or relating to a Start With A Date event.

11. These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

12. You acknowledge that you have read the Start With A Date policy, the terms of which are incorporated herein. You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder. I HAVE READ THIS AGREEMENT AND AGREE TO ALL OF THE PROVISIONS CONTAINED ABOVE.
